Whenever you are taking a picture of something with a known copyrighted or trademarked item, you should get permission. This could even include things like well known buildings owned by corporations, etc. However, there is some leeway to this. If the work is "art", you can possibly get away with it, but I do think you are stretching the intent of the copywright law. For example, a photographer had a huge New York show of his work, which contisted totally of taking pictures of Marlboro Man ads, then changing their colors a little, and saying this was his collection. The original photographer wasn't happy, but most of the visitors just thought his "art" was great. He was getting paid to show this collection.

But just so you know, the hard and fast rule is that you need to get permission. If you take a great picture of Mickey Mouse, for example, you arent' supposed to run out and make postcards without getting Disney's permission. ybarra-cgm.com

The flip side of course, is that post card companies show whole city landscapes and I'm sure they don't get every corporations permission.
